IEP and 504 Issues and Questions

First off I like having this anonymity this form provides. We have another IEP meeting coming up I’m nervous. This one is potentially to discuss the results from the FBA. I personally feel like I struggle communicating with the school. The teachers feedback says one thing and my child another. I ask for things outside team members (non school district people) mention to me to request. And none of them ever seem to know what I am talking about. Hello! I have been doing research to try to figure out how to inform/educate my son’s teachers that reading his texts out loud is how he understands the material. My son is a junior in high school. Unfortunately, he has three classes where students are expected to read silently for most of a 90-minute class period (As a retired English teacher of 25 years, don’t even get me started on my thoughts on this matter. I rarely asked students to read silently in class without a specific reason and/or audio support.) Mn- If we talk to another school district about transferring our child to them, will they go back and talk to our current school district? Is transportation covered? They have IEP with transportation currently. We are considering transferring our child to another school district due the school not meeting our child's learning and disability needs (mainly due to them not wanting to meet them as they are known for not accepting kids with special needs). I spoke with the director of special education at my daughter's district today about how I was treated at her IEP meeting. I told her I requested prior written notice with an explanation of why my proposal was refused and she said "how could we provide prior notice before the meeting was held?" I said prior means before a change is implemented or refused, and she said "ok..." I said "I can send you the language from IDEA if that helps". She didn't like that suggestion...

Question: What strategies have you found effective for managing your child's behavior at school? How did you work these into their IEP?

Private school lowers grades when students are given modifications to curriculum. If modified 20% best student can make is a B and if modified 70% a C. They will not give support to a student if you don't sign a contract to give lower grades. Is this legal? Help

My daughter is currently on a 504 plan. She is homebound because of debilitating anxiety around school. Ironically she is a brilliant actor and singer and participates in the school theater productions. She just finished up Cinderella a few weeks ago (she played Cinderella!). Hello, A parent reached out to me for support but the school is saying a bunch of things I've never heard of so I wanted to reach out to others for input. This parent's child attended school "A". What should and should not be included on the profile page of an IEP?

I have a few questions which I hope the community can answer: Is there a specific timeline for requesting an IEE after the school completes testing? To whom is an IEE request addressed to? The school principal, school district SPED director, state agency? If the IEP goals aren't measurable (and the school was aware,) can I argue for an IEE? My child is moving over to Middle School next school year, should there be a transition meeting which includes the SPED teacher at the new school? I requested during the open house for my daughter to be reevaluated for speech therapy. I hadn't heard anything from the teacher so I recently asked about it. She dated that the speech therapist talked to my daughter and looked at the prior eval and said there still was no need for her to have therapy in school. My daughter is hard to understand at times even for myself and my husband, but she will repeat herself until we understand. My question is, do I push for a full evaluation to be done even if they don't WANT to do it? She is getting therapy outside of the school. I want to make sure she is able to be better understood as she gets older, she is 15 now.

I need help finding the supporting legal definition of “school-endorsed activity.” As I understood from IDEA 34 C.F.R. §§ 300.320, 300.107, and 300.117, IEPs also cover extracurricular activities as long as the activity is endorsed by school. What is the litmus test to determine if an activity is endorsed by the school? I would appreciate if you could provide as much detail as available for this test as extracurricular activities take so many different shapes and forms. Long story but we declined eval (for now) and agreed to FBA. Two days later a PWN is sent home to us in unsealed envelope in my kids backpack. Which of course he read and a friend had been messing around and almost ‘got’ the envelope from him. He was all freaked out about it. This method of communicating seems wrong on many levels. Same thing last year with 504 - unsealed envelope handed to kid. Is this how your schools send formal legal documents containing private information???

For those with kids with health issues that cause intermittent absences how is tutoring implemented? I have a high school freshman who has already missed ten days of school this year. I would like to have tutoring written into his IEP as a related service and would love detailed examples of what has worked for others in a similar boat. Sometimes he just misses a day or two and then he's back in school other times he's missed several weeks or more. If we know it will be a long absence we get him on home hospital but for these shorter term periods I feel it's important to have a tutoring plan in place through his IEP. I'm trying to look for any resources on the matter. I read the articles about requesting homebound services and this is a situation that is a bit off the norm. Student is attending a cyber charter through the state and has an IEP for behavior, education autism. Parents have an upcoming evaluation for a medical diagnosis of autism. My 10 yr old has an anxiety and panic disorder as well as ADHD (she has a 504). She is participating this year in a program that is run by a non-profit and hosted at her school. The program consists of 1x weekly activities that take place concurrent with the afterschool program and a 1x monthly field trip that takes place during the school day. During the past two field trips, downhill skiing and cross country skiing, my daughter has expressed significant feelings of frustration that balloon into panic attacks/meltdowns. In a previous ARD meeting I requested Tier intervention for math. It was not approved because they stated that they only do Tier intervention for reading. I did not make that request (directly) in writing but, I did during the meeting. Since our next meeting is coming up and I had not gotten a PWN, I sent an email inquiring about it. They called and left a voice mail indicating that we will talk about it at the meeting. With all of this being new to me, I thought if you requested some service and it was rejected or not approved, a PWN was due. Or did I make a technical error by not putting it in writing?

Good morning, My son is 6 years old and just started Kindergarten in August. He was diagnosed with Type 1 Diabetes at 2 years old and with Autism/ADD within the past 2 years. He is listed as Level 2. I'm sorry for the long post. I'm just at a loss and feel like I'm failing my highschooler if I don't take action. Which will affect their future. My child has Autism but is very high functioning, they are in an EBD (Emotional Behavioral Disorder) classroom that has a teacher that curses the students and feels like it is his job to "turn them into men" by verbally abusing them. Is it ok for a goal to be measured "by staff observation" only? For example: By the end of the 9 weeks, he will follow staff directives 80% of charted opportunities. Success will be measured using staff observation. If it's legit, I digress. Doesn't please though. I will ask for something more concrete, but still want to know in your opinion if it's acceptable. What are the differences between 504 & IEP? I read that in Mississippi a hearing impairment automatically qualifies a student for a 504. My son has always had an IEP. The school has never mentioned anything about the 504.

I know, I know, I'm supposed to want recess for my child. I even read the article about fighting for recess. Intellectually, I know it's important. But with the new school year approaching, I am seriously considering looking into getting recess skipped for my child. She will be in the third grade. My state is very pro-recess and has it included in state law. It's also part of, by not only the teacher's union contract and state public employee law, the teacher's duty-free break time. Hi - I have a 14 yr old son with ADHD (inattentive type) and I am looking for a list of possible homework accommodations that have been used by others in a NYC public school successfully. Has anyone had success getting all their kids work listed on Google Classroom? Last year, teachers did not "check in" homework during class time so I would only find out it had not been completed when his grades were posted a week-ish later. Is this normal? My child already has an IEP in place. I am struggling in advocating for them as they having a hard time in the mainstream class setting but they are above grade level academically. They are too young for any kind of Gifted and Talented style program. They have delays in their emotional regulation and their social skills with peers.
