IEP and 504 Issues and Questions

How does this present with ADHD combined? Are they often confused —like go to an audiologist and you’ll get the auditory processing Dx, but go to a nueropsych and you’ll get the ADHD Dx? Does a language processing eval help to rule out tolerance fading memory or just help to see if other issues are also present? Can anything mask tolerance fading memory? Is it a 504 or IEP?

Is it ok for a goal to be measured "by staff observation" only? For example: By the end of the 9 weeks, he will follow staff directives 80% of charted opportunities. Success will be measured using staff observation. If it's legit, I digress. Doesn't please though. I will ask for something more concrete, but still want to know in your opinion if it's acceptable. I spoke with the director of special education at my daughter's district today about how I was treated at her IEP meeting. I told her I requested prior written notice with an explanation of why my proposal was refused and she said "how could we provide prior notice before the meeting was held?" I said prior means before a change is implemented or refused, and she said "ok..." I said "I can send you the language from IDEA if that helps". She didn't like that suggestion...

Are the completed teacher rating scales viewable under FERPA? Scales were only given to one teacher who spends far less time with my child and school refuses to reissue observation scales to the teacher present for a longer duration of the school day with my child. (Note my child splits classrooms so neither teacher is present with the other one.)

I was in an IEP meeting yesterday for my daughter, it was the most contentious IEP meeting I have ever been in and I am also a practicing school psychologist. The district was not at all interested in having a discussion surrounding my proposal, and rather said they disagree, let's talk about mediation and due process. In my opinion, due process should be an absolute last resort and there should be thorough discussion of the matter prior to getting to that point. Hi all. My 11-year-old 5th grader has confirmed diagnoses of ASD (diagnosed age 2) and ADHD Inattentive Type (diagnosed February 2026). He has had a 504 plan in place since the first time we were denied evaluations at all at the end of 3rd grade. We are in Missouri. The district completed an initial special ed evaluation and denied eligibility. I verbally disagreed with the determination in the meeting and did not sign anything. Hi guys, Do any of you have an example of present levels for a second-grader in any or all of the areas below and how they were determined? We have an upcoming Initial Evaluation for Eligibility and I can't tell what the student's present levels are for any of the below. I'm considering filing a Child Find violation against my school district. My child was identified by the school in 9th grade. Now, the school can't meet their needs because the needs are so great. My child was in advanced classes not long ago. Now,they're in remedial classes and not on the college track. They're failing a class and will likely need to re-take it next year. They don't have the skills to execute work, although cognitively they are able to understand and do the work. If a child does not have an IEP but was told the school is drafting one, can a child with behavior issues be denied to go on a field trip with the rest of his kindergarten class?

My son is in 6th grade and has several qualifying diagnoses (Autism, Health (ADHD), Specific Learning Disability (Dysgraphia), and Anxiety). He has been succeeding with a very extensive 504 plan, but things have recently taken a turn for the worst. My son is in 8th grade and has an IEP for ADHD & SPD. He struggling the first semester with his math teacher and it got to the point where she just wrote him office referrals for lunch detention multiple times a week. It was a toxic environment. His IEP Team and I decided changing teachers at semester would be a good idea and he's now been in the new class for 2 weeks. He's doing great and doing his work, etc. No behavior issues. I'm trying to look for any resources on the matter. I read the articles about requesting homebound services and this is a situation that is a bit off the norm. Student is attending a cyber charter through the state and has an IEP for behavior, education autism. Parents have an upcoming evaluation for a medical diagnosis of autism. The school is the type that requires a parent or someone they provide to be the "learning coach". I requested during the open house for my daughter to be reevaluated for speech therapy. I hadn't heard anything from the teacher so I recently asked about it. She dated that the speech therapist talked to my daughter and looked at the prior eval and said there still was no need for her to have therapy in school. My daughter is hard to understand at times even for myself and my husband, but she will repeat herself until we understand. My question is, do I push for a full evaluation to be done even if they don't WANT to do it? She is getting therapy outside of the school. I want to make sure she is able to be better understood as she gets older, she is 15 now.

The school is proposing to reduce my child's 1:1 minutes. There is recent behavioral data to support that this is not warranted. An IEP meeting is being scheduled and I just want to make sure I am going about this correctly. If I disagree with the change and ask for a PWN, what are the next steps?

I had this client many moons ago. She had several kids with IEPs. She was very difficult to deal with, to say the least. Then, with one of her kids, we went to mediation with the IU (IUs are a PA thing) and we got EVERYTHING she asked for. Cool. The next day, she called (maybe emailed) the IU, without consulting me, and said NO to everything. That she was withdrawing the kid. My contact person at the IU called me, it was a hot mess. My son has an IEP for speech, which he has mastered, and they have kept him on to get him approved for an OHI IEP. We are in TN, and I have had an increasingly difficult time in our school district with accommodations. He has ASD and was diagnosed with GAD also last year he was diagnosed with a neurological disorder in his colon. He is 7 and not potty trained, which has been a problem with the school. He is in Gen Ed, high functioning and they do not provide any kind of assistance. He is expected to go to the bathroom and take care of all his needs on his own, the problem is he won't. Every kid is different, but sometimes we hear about an accommodation and think, why didn’t I ask for that?! What’s an accommodation that has made a huge difference for your child?

Minnesota- Our child recently had an IEE completed and we just got back the results. The results came back in our favor. Additional diagnosis's and how they impacting our child at school. We emailed the school requesting an IEP meeting to review the IEE, discuss the recommendations, and update the IEP. The school is refusing to allow the IEE evaluator to come to the meeting since it's an additional charge. I'm concerned the school is going to try placing everything on our child or say they refuse help (even though the IEE addresses why that would happen for our child) and refuse to change anything. It has been a long day (month, year) at this school so forgive my bluntness: 11 meetings this year so far (2 kids) and still at least 2 more to go with IEEs 😶😵‍💫😲 Not only have the Generic, drop-box, completely inappropriate crap goals not improved, the newest draft IEP went from 3 crap goals to 1!!!!!! It appears that putting crap goals in IEPs is a great tactic as I have not read one due process case (or met a lawyer willing to take a case) based on crap goals. My 10yo son was diagnosed with brain cancer this summer. When school started he was not doing great, and school pushed for wheel chair and (as we learned last week) made his aide check water intake, bathroom breaks, etc - none of that was requested by us or listed in the doctor’s note. In a previous ARD meeting I requested Tier intervention for math. It was not approved because they stated that they only do Tier intervention for reading. I did not make that request (directly) in writing but, I did during the meeting. Since our next meeting is coming up and I had not gotten a PWN, I sent an email inquiring about it. They called and left a voice mail indicating that we will talk about it at the meeting. With all of this being new to me, I thought if you requested some service and it was rejected or not approved, a PWN was due. Or did I make a technical error by not putting it in writing?
