IEP and 504 Issues and Questions

In a previous ARD meeting I requested Tier intervention for math. It was not approved because they stated that they only do Tier intervention for reading. I did not make that request (directly) in writing but, I did during the meeting. Since our next meeting is coming up and I had not gotten a PWN, I sent an email inquiring about it. They called and left a voice mail indicating that we will talk about it at the meeting. With all of this being new to me, I thought if you requested some service and it was rejected or not approved, a PWN was due. Or did I make a technical error by not putting it in writing?

This is something I have not been able to find information tied to anywhere. If there is, please direct me to the information. 🙂 A little background information tied to our situation I think will help: Our son is extremely intelligent yet suffers from processing speed issues in certain areas. So we just had our very first IEP meeting. the district allocated one hour! I thought the IEP committee together would develop our student’s IEP, but what happened was someone from the district we never met before came in with a premade IEP. She clearly expected to present it and then have us sign off at the end of the meeting. The meeting started late and people had to go so we have another meeting planned. Good morning, My son is 6 years old and just started Kindergarten in August. He was diagnosed with Type 1 Diabetes at 2 years old and with Autism/ADD within the past 2 years. He is listed as Level 2. He is verbal but is a gestalt language learner. He has been in private OT and Speech for years now. He just started Kindergarten at a public school in West Virginia. Can language therapy be added to a 504 plan or does this need to be an IEP? This case is in Missouri.

A "life skills-type class" was recently brought up as a possibility for my 8 year old with ID. What kind of life skills do they teach 8 year olds? She takes care of her own hygiene needs and I believe her other skills (except academic skills) are on par or maybe only slightly behind her same age peers. Her academic needs are significant (still considered a pre-reader or maybe beginning K reader, and working on addition/subtraction within 1-10) but she can understand and retain a lot of information that she hears (not all, but a fair amount). I don't know, it seemed to be a very "we don't know what to do with her, so how about this" type of suggestion.

Posting for a reader: Do you have templates or examples of specific and strongly worded Present Levels statements for highly cognitive teens who face social, emotional, and major executive functioning challenges? My son's therapeutic school tends to downplay his needs in his IEP and progress reports. While he has significant potential, his progress has been severely limited by massive work-avoidant behaviors. Any resources you could share to help ensure his IEP accurately reflects and addresses his challenges would be greatly appreciated.

Looking for guidance...I'm a working mom to a 6 year old who was a micro-preemie diagnosed with cerebral palsy. I'm trying to look for any resources on the matter. I read the articles about requesting homebound services and this is a situation that is a bit off the norm. Student is attending a cyber charter through the state and has an IEP for behavior, education autism. Parents have an upcoming evaluation for a medical diagnosis of autism. When talking about ADHD medications what are the pro/con of medicating the day of the test versus not? My District had started to default to virtual meetings, are there any provisions that can force all participants to be in person? I personally dislike when District participants are together in the same office for a zoom and parents are elsewhere. It seems unbalanced and ripe for sidebars parents aren’t privy to. It was convenient to have meetings virtually during covid and convenient now if someone can’t make it to school, but in person is still very much my presence.

We had our middle school articulation meeting as my child (ADHD & 2e, with poor executive function) is going into middle school next year. They said they will keep all my child's accommodations, but not the pull outs because the school "doesn't do that". Is this legal? She has not met her most of her IEP goals. And has definitely the goals for spelling and executive function. She gets pulled out for spelling using Wilsons. I've only ever seen motor skills and OT/PT related to younger students. How do you approach a high school regarding a teen who is unable to participate fully in Phys Ed due to symptoms of a gene mutation? She is required to get PE credits for graduation but is not participating in the class. Mostly sitting on the bench. Posting for a reader: I have a question regarding the transportation for my son that his local public school provides. Last year at the end of the school year my son was attacked by another student on the same van. The student also pulled another child’s hair and also grabbed the van driver’s arm while driving. The other child goes to the same private school as my son but is a student in another school district, but the same county as we live in. The school is not in our county it is about 48 miles each way. The public schools have a contract with a local company to provide bus and van services. We moved to our 3rd district in TN and they are stating she can't have her personal iPad with her TD Snap app but must use a school issued iPad. IEP from previous district lists her iPad as her speech generating device. In description they specifically mention my daughter "brings her own communication device to school, however the school has a backup device if needed." New school wants to replace personal iPad with school issued iPad after my nonverbal daughter was "caught" taking screenshots of the sentences she created in her own AAC device. I have a student undergoing evaluation under OHI due to multiple medical conditions that are limiting participation at school and in general with ADLs. What happens if the school decides to deny certification under OHI but the physician on the MET team completes the form stating they are limited in vitality, etc to the definition under OHI? Our state rules (MI) require a physician to be part of the decision making team. The school has been very set against offering support unless the student is failing.

An IEP was prepared in private by people who don’t know our student and then presented as a done deal at the IEP meeting which involved parents, teacher, bilingual special Ed teacher. Thanks to coaching from this forum we requested an advanced copy of any documents the district planned to bring. We gave brought careful written feedback to hand out to each person at the meeting. My 10yo son was diagnosed with brain cancer this summer. When school started he was not doing great, and school pushed for wheel chair and (as we learned last week) made his aide check water intake, bathroom breaks, etc - none of that was requested by us or listed in the doctor’s note. My child already has an IEP in place. I am struggling in advocating for them as they having a hard time in the mainstream class setting but they are above grade level academically. Private school lowers grades when students are given modifications to curriculum. If modified 20% best student can make is a B and if modified 70% a C. They will not give support to a student if you don't sign a contract to give lower grades. Is this legal? Help

My son is in 7th grade and having a psychoeducational evaluation done. He just exited an IOP (Intensive Outpatient Program) for depression and anxiety. He was in the program for 2 months. He currently has a 504 plan for ADHD and anxiety, but things have gotten significantly worse since school began this fall. He has meetings with the school adjustment counselor to work on anxiety in his 504, but the school psychologist thought it made sense to do a psychoed eval where his mental health has been so poor. Long story but we declined eval (for now) and agreed to FBA. Two days later a PWN is sent home to us in unsealed envelope in my kids backpack. Which of course he read and a friend had been messing around and almost ‘got’ the envelope from him. He was all freaked out about it. This method of communicating seems wrong on many levels. Same thing last year with 504 - unsealed envelope handed to kid. Is this how your schools send formal legal documents containing private information???

My daughter is in 1st grade and really struggling to read. She has between a half hour to an hour of homework each day. I am concerned at this point in the year with her lack of progress. I wonder if she maybe has dyslexia and the teacher said the school does not worry about the possibility until 3rd grade. Unfortunately, she is struggling NOW. In my child's newest IEP it says she is to spend 400 hours weekly in the resource classroom for reading, writing, and math. The school has been doing standardized testing for the past month, and during that time it looks like she's been getting maybe 25 minutes for just math, and not even everyday. I think they use the classroom for testing for some of the kids. Are they allowed to cut down her hours like that for testing? She's missed out on at least 1000 hours of instruction time due to this.
