IEP and 504 Issues and Questions

Question: What strategies have you found effective for managing your child's behavior at school? How did you work these into their IEP?

My daughter is in 1st grade and really struggling to read. She has between a half hour to an hour of homework each day. I am concerned at this point in the year with her lack of progress. I wonder if she maybe has dyslexia and the teacher said the school does not worry about the possibility until 3rd grade. Unfortunately, she is struggling NOW. What should I do, and, or, ask for to initiate testing?

Hello, My daughter is on a 504 plan but I have requested for her to be tested for Special Education because of poor progress with grades and her disruptive behavior. The school has us to agree to oral testing , adding that most of their ADHD students are orally tested. I have put them off but got a call last Friday so I really don't know the pros & cons of doing so. She has no problem reading from our observation and the school's given statement.

In PA, does a diagnosis (say dyslexia) a documented thru nueropsych/academic testing, can scjool tefuae a 504 or IEP request and only offer RTI reading support (pull out small group to the reading specialist)? As a side note, district does NOT use the RTI model to identify SLDs-they use discrepancy model.

Mu child is under an evaluation request. I believe the 60d ends today or tomorrow. School just sent me a request for parent input. I need more time than a few hours to write a thoughtful response to be included. Is my timeline impacted by providing input after day 60?

so this is for a close pal so I need to keep this fairly generic but they handed in a IEP eval a request this AM to the district office and then met with the principal to start a 504 this afternoon (their kid needs some emotional support help ASAP) and the principal brought in the school psych and they proceeded to tell the parents that the kid could not qualify as they said he had no learning differences (they must have showed an old IQ test..only an iq test not a full neuropsych) and that they insisted that IEPs are not meant for emotional disabilities, only for academic reason. This 9th grader has ASD, ADHD, plus. He has no friends and has been bullied for years. Now 1 year in this state/district where they say he doesn’t qualify for Speech and Language (had from k-8 then PA eval said he doesn’t qualify 🤷‍♀️). We had our middle school articulation meeting as my child (ADHD & 2e, with poor executive function) is going into middle school next year. They said they will keep all my child's accommodations, but not the pull outs because the school "doesn't do that". Is this legal? She has not met her most of her IEP goals. And has definitely the goals for spelling and executive function. She gets pulled out for spelling using Wilsons. Yet her spelling is below grade level and she can not write a 3 sentence paragraph independently on her own. I'm sorry for the long post. I'm just at a loss and feel like I'm failing my highschooler if I don't take action. Which will affect their future. My child has Autism but is very high functioning, they are in an EBD (Emotional Behavioral Disorder) classroom that has a teacher that curses the students and feels like it is his job to "turn them into men" by verbally abusing them. My general education 5th grader is being recommended for a social skills group with the school social worker. He had an IEP from end of 1st grade thru mid 4th grade for Speech, which is how I know about this forum. This year teachers have observed that sometimes he forgets about personal space (his classroom does have 30 students this year...) or forgets to check in with the members of a conversation. Hello! I have been doing research to try to figure out how to inform/educate my son’s teachers that reading his texts out loud is how he understands the material. My son is a junior in high school. Unfortunately, he has three classes where students are expected to read silently for most of a 90-minute class period (As a retired English teacher of 25 years, don’t even get me started on my thoughts on this matter. So we just had our very first IEP meeting. the district allocated one hour! I thought the IEP committee together would develop our student’s IEP, but what happened was someone from the district we never met before came in with a premade IEP. Since we’ve had my son’s Initial IEP, they rejected my request for a 1:1 aide. Since then he’s been having weekly episodes of aggression at school—and he hasn’t been aggressive before. He was recent diagnosed with Autism and ADHD and is minimally verbal. He’s assaulted classmates and a teacher and I truly feel that with a 1:1 aide, it would minimize these meltdowns. Has anyone experienced sudden aggression in their little on? Any advice would be very helpful. I’m just scared that if this continues he would be pulled from the general classroom.

I've only ever seen motor skills and OT/PT related to younger students. How do you approach a high school regarding a teen who is unable to participate fully in Phys Ed due to symptoms of a gene mutation? She is required to get PE credits for graduation but is not participating in the class. Mostly sitting on the bench. Hello, A parent reached out to me for support but the school is saying a bunch of things I've never heard of so I wanted to reach out to others for input. This parent's child attended school "A". At school A in Jan. 2024, the school switched him from an IEP to a 504 plan. The parent said she disagreed with this but the school did it anyway. My daughter is 15. Her diagnosis are ADHD/SPD/GAD. She has had an IEP for OHI since 1st grade. Her current goals are math and adaptive behavior (planning/prioritizing, task completion, impulse control and appropriate interactions with peers). The IEP also has as many of the age appropriate accommodations for high school (extra time on tests, quiet place to test, alternate testing methods, headphones for noise reduction, speech to text, and more). Is there a requirement that when doing an evaluation, the child has to have input? School did a sensory evaluation consisting of only the school companion of the Sensory Profile 2, but did not provide the parent or student with any opportunity to participate in the sensory evaluation (10 yo). Is the Sensory Processing Measure a better evaluation? Does anything take into account the child feedback versus solely relying on a teacher to be noticing? Seems a little one-sided if only one person is asked to evaluate for a concern, especially if there's very subtle things happening and kid "flies under the radar". What might be an underlying reason(s) for difficulty making inferences? I read the blog article on inference goals, but am curious what “diagnosis” might warrant inference goals? Currently no learning disability diagnosis. Processing speed is just much higher than working memory.

Private school lowers grades when students are given modifications to curriculum. If modified 20% best student can make is a B and if modified 70% a C. They will not give support to a student if you don't sign a contract to give lower grades. Is this legal? Help

Hi - I have a 14 yr old son with ADHD (inattentive type) and I am looking for a list of possible homework accommodations that have been used by others in a NYC public school successfully. Has anyone had success getting all their kids work listed on Google Classroom? Last year, teachers did not "check in" homework during class time so I would only find out it had not been completed when his grades were posted a week-ish later. Is this normal? My son is in 7th grade and having a psychoeducational evaluation done. He just exited an IOP (Intensive Outpatient Program) for depression and anxiety. He was in the program for 2 months. He currently has a 504 plan for ADHD and anxiety, but things have gotten significantly worse since school began this fall. He has meetings with the school adjustment counselor to work on anxiety in his 504, but the school psychologist thought it made sense to do a psychoed eval where his mental health has been so poor. Long story but we declined eval (for now) and agreed to FBA. Two days later a PWN is sent home to us in unsealed envelope in my kids backpack. Which of course he read and a friend had been messing around and almost ‘got’ the envelope from him. He was all freaked out about it. This method of communicating seems wrong on many levels. Same thing last year with 504 - unsealed envelope handed to kid. Is this how your schools send formal legal documents containing private information???

I need help finding the supporting legal definition of “school-endorsed activity.” As I understood from IDEA 34 C.F.R. §§ 300.320, 300.107, and 300.117, IEPs also cover extracurricular activities as long as the activity is endorsed by school. What is the litmus test to determine if an activity is endorsed by the school? I would appreciate if you could provide as much detail as available for this test as extracurricular activities take so many different shapes and forms. Like I said, I'm a general teacher. Happy to do whatever my role is. However, this year I have a parent who had a bad experience with the SPED team at her kid's last school and said she wants as little to do with them as possible. I've notified the sped team and they're trying to be as great as they can, but the parent is resistant. She says she wants all services and communication to come through me. Is this a reasonable request?
