IEP and 504 Issues and Questions

I have a student undergoing evaluation under OHI due to multiple medical conditions that are limiting participation at school and in general with ADLs. What happens if the school decides to deny certification under OHI but the physician on the MET team completes the form stating they are limited in vitality, etc to the definition under OHI? Our state rules (MI) require a physician to be part of the decision making team. The school has been very set against offering support unless the student is failing.

Is there a requirement that when doing an evaluation, the child has to have input? School did a sensory evaluation consisting of only the school companion of the Sensory Profile 2, but did not provide the parent or student with any opportunity to participate in the sensory evaluation (10 yo). Is the Sensory Processing Measure a better evaluation? Does anything take into account the child feedback versus solely relying on a teacher to be noticing? Seems a little one-sided if only one person is asked to evaluate for a concern, especially if there's very subtle things happening and kid "flies under the radar". Are the completed teacher rating scales viewable under FERPA? Scales were only given to one teacher who spends far less time with my child and school refuses to reissue observation scales to the teacher present for a longer duration of the school day with my child. (Note my child splits classrooms so neither teacher is present with the other one.)

My District had started to default to virtual meetings, are there any provisions that can force all participants to be in person? I personally dislike when District participants are together in the same office for a zoom and parents are elsewhere. It seems unbalanced and ripe for sidebars parents aren’t privy to. It was convenient to have meetings virtually during covid and convenient now if someone can’t make it to school, but in person is still very much my presence.

First off I am mentally drained. My child is a literal and often very inflexible thinker. 7 years old and in 1st grade. He has an IEP. No ASD diagnosis that’s a whole separate rabbit hole in it’s self. We have ran into several scenarios where he takes statements and can’t bend his thinking. Like I said, I'm a general teacher. Happy to do whatever my role is. However, this year I have a parent who had a bad experience with the SPED team at her kid's last school and said she wants as little to do with them as possible. I've notified the sped team and they're trying to be as great as they can, but the parent is resistant. She says she wants all services and communication to come through me. Is this a reasonable request?

In PA, does a diagnosis (say dyslexia) a documented thru nueropsych/academic testing, can scjool tefuae a 504 or IEP request and only offer RTI reading support (pull out small group to the reading specialist)? As a side note, district does NOT use the RTI model to identify SLDs-they use discrepancy model.

And if so, is it considered a reasonable accommodation? In the casual world, I've heard various complaints about IEP accommodations assigning another student to help them. Some say it stresses the student helper out too much, and even one story said the parent pulled the kid from school as the kid shouldn't be doing a teacher or para's job. But it's also seemed a good idea in popularity fit quite some time, so what's the current view?

I've only ever seen motor skills and OT/PT related to younger students. How do you approach a high school regarding a teen who is unable to participate fully in Phys Ed due to symptoms of a gene mutation? She is required to get PE credits for graduation but is not participating in the class. Mostly sitting on the bench. I know, I know, I'm supposed to want recess for my child. I even read the article about fighting for recess. Intellectually, I know it's important. But with the new school year approaching, I am seriously considering looking into getting recess skipped for my child. She will be in the third grade. My state is very pro-recess and has it included in state law. It's also part of, by not only the teacher's union contract and state public employee law, the teacher's duty-free break time. I remember coming across a template for "About me" to give to a new teacher on the adayinourshoes site. If anyone happens to know where that is could you please share it? I want to start collecting my thoughts on what to give to his teacher this year. I *could* make my own if I absolutely must but I fear it wouldn't be to the point enough. Not a current situation I'm in, just going through the thoughts of theoreticals from a Reddit thread. I know what the school pays for any aides, technologies, etc. But what about the smaller things? Like, if students are supposed to get rewards to help with goals, or have wiggle chairs or chair bands? In the Reddit conversation, teachers were complaining about having to buy those with their personal money, but I've also never heard of those being paid for via the IEP. I hate the idea of teachers having to pay for everything, but to some extent it feels like paying for some of it is just part of the job expectations. Or are parents supposed to send those in?

I'm sorry for the long post. I'm just at a loss and feel like I'm failing my highschooler if I don't take action. Which will affect their future. My child has Autism but is very high functioning, they are in an EBD (Emotional Behavioral Disorder) classroom that has a teacher that curses the students and feels like it is his job to "turn them into men" by verbally abusing them. I told her I requested prior written notice with an explanation of why my proposal was refused and she said "how could we provide prior notice before the meeting was held?" Hello, I'm working on our parent concerns letter for our meeting next week. This is our first year dealing with an IEP and I'm pretty lost! I was in an IEP meeting yesterday for my daughter, it was the most contentious IEP meeting I have ever been in and I am also a practicing school psychologist. The district was not at all interested in having a discussion surrounding my proposal, and rather said they disagree, let's talk about mediation and due process. In my opinion, due process should be an absolute last resort and there should be thorough discussion of the matter prior to getting to that point. An IEP was prepared in private by people who don’t know our student and then presented as a done deal at the IEP meeting which involved parents, teacher, bilingual special Ed teacher. Thanks to coaching from this forum we requested an advanced copy of any documents the district planned to bring. We gave brought careful written feedback to hand out to each person at the meeting. The district IEP presenter walked us through the IEP. She had prepared. After the meeting, we gave very careful thorough item by item, written feedback again. Mu child is under an evaluation request. I believe the 60d ends today or tomorrow. School just sent me a request for parent input. I need more time than a few hours to write a thoughtful response to be included. Is my timeline impacted by providing input after day 60?

My daughter is currently on a 504 plan. She is homebound because of debilitating anxiety around school. Student has ADHD diagnosis and is 8 years old. Lives in IL. ONE Teacher is sending home messages everyday about all the things the student is doing wrong. School won’t consider a 504 or IEP because “his grades are too good”. The school psychologist is the one who did all the testing on our student. in the IEP She says that she will spend a half hour twice a month helping her. In the first IEP meeting the district representative made a point of saying that school psychologist time is an extremely valuable asset that the District is committing to the student. We suddenly have our daughter's IEP tomorrow. We can't postpone because tomorrow is the last day the yearly IEP can be held. We hope to get her into a private school next year as she transitions into middle school. I would like to include some goals that will work with the private school, or at least be tolerable for them. While the determination is made for a 504 or IEP school has told a friend child can’t be in school due to medical issue unless they have a physician note on file documenting the condition (or at least providing the explanatory it) do an action plan can presumably be developed. Family is working to get the note, but pediatrician has asked for specialist consults because they don’t want to jump to quick Dx without ruling out other things just in case.
